In order to legally work in the United States, you must have authorization from the INS. This comes in the form of a visa, or a change to a legal status, which permits employment. Employment visas are generally employer specific; in other words, you cannot change employers without reapplying for permission from the INS. Generally, the first step is to find a job. All the employment-based visas require evidence of a job off before a request for an employment-based visa can be submitted.

To establish which visa would be most suitable for your particular circumstances please examine the following options:

  1. If you have the equivalent of a four-year college degree, examine the H-1B visa option for temporary US employment.

  2. If you are being transferred from a non-US Company to work in the US, examine the L & E Visa options for inter-company transferee or management

  3. If you can fill a position that the US employer cannot fill with US workers, examine the Labor Certification visa for permanent employment.

  4. If you are a Canadian or a Mexican national with a professional skill, examine the NAFTA, TN Visa  option.

  5. If you have exceptional skills of interest to the US, examine the National Interest Visa for your exceptional or extraordinary abilities.
